Notwithstanding any statements on the Safeway.com web pages or elsewhere, these Special Terms and Conditions are the agreement between you and Safeway. By completing the on-line registration process, submitting each order and completing the checkout process, you confirm and affirm that you have read, understood and agree to these Special Terms and Conditions, and the form in which they appear at the time your on line registration is completed.
You agree that because of the nature of the Internet, the online shopping service is provided on an "As Is" and "As Available" basis. We are not liable to you if we are unable to supply a particular item. If you would like out-of-stock items substituted, please specify the type of replacements you would prefer on the Substitutions page during Checkout. If you are not satisfied with any substitution selected, you may return it to the physical store, or with the delivery driver for a full refund.
At this time, we are unable to issue or accept rain checks or coupons online. We are currently in the process of developing enhancements to the Site so we may provide this service to you in the future.
We will make every attempt to deliver on all your orders; however, large orders of specific items will be fulfilled at the discretion of the physical store from which your items are selected. For example, if you were to make an order of 100 bottles of wine, which would use up all that physical store's stock, you may only receive 50 bottles.
For the safety of your account, we route some orders through our loss prevention department. If we suspect any fraudulent activity on your account, we will promptly notify you that the processing of your order may be delayed and/or cancelled if necessary. We reserve the right to decline orders, refuse partial or full delivery, terminate accounts, and/or cancel orders at our sole discretion.
Delivery times will be as agreed at the time of order. All goods must be signed for on delivery by an adult 18 years of age or older. The goods will be retained by the driver if no adult is at the delivery address when the delivery is attempted. The driver will leave notification of delivery and will telephone to reschedule delivery or will return later the same day. Orders will be accepted only from the individual registered with the online service and deliveries will only be made to the address that they have registered.
A service (delivery) fee applies to all orders, no matter how small or large, and is nonrefundable. The service fee covers the costs associated with fulfilling each order. Please see "about deliveries" in the customer help section for applicable charges.
You represent and warrant to Safeway that your use of any credit card is authorized and legal.
If an item is missing from your order, you have 48 hours from the time of delivery to notify Safeway.com Customer Service for a full refund. Refunds will not be given for an item missing from your order after the 48 hour time window.
To serve you better, we may combine information you give us online, in our stores or through our catalogs. We may also combine that information with publicly available information and information we receive from or cross–reference with our Select Partners and others. We use that combined information to enhance and personalize your shopping experience with us, to communicate with you about our products and events that may be of interest to you, and for other promotional purposes.
(b) Inbound Links. Linking to any page of the Site other than to “http://www.Safeway.com” through a plain text link is strictly prohibited in the absence of a separate linking agreement with Safeway. Any web site or other device that links to http://www.Safeway.com or any page available therein is prohibited from (a) replicating content, (b) using a browser or border environment around the content, (c) implying in any fashion that Safeway or any of its subsidiaries or affiliates are endorsing it or its products, (d) misrepresenting any state of facts, including its relationship with Safeway or any of its subsidiaries and affiliates, (e) presenting false information about Safeway products or services, and (f) using any logo or mark of Safeway or any of its subsidiaries or affiliates without express written permission from Safeway.
Pricing information: The current Safeway Fee Schedule may be obtained by calling Safeway Customer Service at (877) 505-4040. Monday through Friday from 9 am to 9 pm Pacific Time, Saturday and Sunday from 9 am to 5 pm Pacific Time. Safeway reserves the right to add, delete or change fees or charges at any time upon notice as provided in this Agreement.

Safeway does collect additional information from Safeway Club Card members. The information we receive depends on what you do when you visit our online and physical stores and use your card. We collect and store your name, address, home telephone number, and birth date if provided by you. If you are in an area where we offer electronic checking and apply for this service, we also ask for information such as your bank and credit card account numbers. When you make purchases, we record data about the transaction including the amount and content of your purchases and the time and place these purchases are made.
In addition, Safeway.com receives a confirmation when you open e-mail from us if your computer supports such capabilities. We may at times compare our customer list to lists received from other companies, in an effort to avoid sending unnecessary messages to our customers.
If you do not want to receive email from us, please log in and adjust your Email Preferences under My Account. You may also send an email to Safeway@subscribers.safeway.com with the word "unsubscribe" in the subject line and your email address to unsubscribe in the message.
Safeway does not sell or lease personally-identifying information to any other company, person or agency. Safeway will disclose personally-identifying information only if required to do so by law, or if requested to do so by a law enforcement agency in the context of an ongoing criminal investigation where such disclosure could be required by subpoena or court order. Any request for information must be cleared by our Legal Department. In addition, Safeway may use any information our customers provide when conducting our own investigations of alleged customer wrongdoing, such as dishonored or fraudulent method of payment.
Safeway may create compilations of information that is not personally-identifying and provide this data to other companies to help them understand the shopping patterns of our customers.
